No Liability for Other Members or User Content
XIPHION includes optional social features (the "Sphere") through which members may create public profiles and exchange messages. Profiles, messages, and any other material created by members ("User Content") are the sole responsibility of the member who created them and do not represent the views of Xirophi Pty Ltd. To the maximum extent permitted by law, Xirophi Pty Ltd does not endorse, verify, or assume responsibility for User Content or for the conduct, identity, statements, or actions of any member, whether online or offline, and disclaims all liability for any loss, damage, distress, or harm arising from your interactions with other members or your reliance on any User Content. You interact with other members entirely at your own risk and are responsible for exercising your own judgement and caution. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Xirophi Pty Ltd and its officers, directors, employees, agents, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: your use of the application, your violation of these terms, your violation of any third-party rights, or any content you submit or transmit through the application. This indemnity does not extend to any liability arising from Xirophi Pty Ltd's own negligence, wilful misconduct, fraud, or breach of a non-excludable consumer guarantee under the Australian Consumer Law.
